When you sign up to use the Job Finder Service, you can either post your information in the form of a resume or input other relevant information (including background, education and vocation information) in a template which will, in turn, generate a resume or job posting using your input. In order to compile that resume or job posting, we may need more specific information about you, such as name, address, e-mail address, telephone number, etc. We also gather comparable information about our other users. We will use this information primarily in connection with efforts to post information concerning the skill sets of Job Seekers in order to match those skill sets with available positions with such Employers. In addition, this information helps us determine what is most beneficial for our users, and how we can develop a better overall website for our users. You understand that this information may be shared with law enforcement and Employers, and that we may use and compile that information as part of our responsibilities to law enforcement, correctional industries and Homeland Security, both now and in the future, at the international, federal, state, county and local levels. III. How we Use and Disclose your information We may use the information you voluntarily supply to operate the Web Site and deliver services. Generally, we do not disclose your information to third parties. However, we may disclose aggregated information without your permission. Further, we may use and disclose your information both internally and externally, including without limitation, as described herein. We may share your information with Employers. We will not sell your information to any other company however, you should be aware that Securus may use this information that you supply about yourself for promotional or marketing purposes. We may disclose all of the information we collect about you to our affiliates, to nonaffiliated third-parties that perform services on our behalf and to governmental agencies. We may disclose all of the information we collect about you to entities and individuals who perform services on our behalf. For example, we may disclose your information to our contractors and subcontractors, attorneys and accountants as necessary to perform their functions. If we collect information from you to provide job matching services requested by you, such third-party's use of your personal information will be subject to their privacy policy as disclosed to you by them. As discussed above, the Job Finder Service attempts to assist Job Seekers in finding employment prior to or after release from incarceration. The data which you input into the Site will either (a) generate a resume which may be searched by Employers or (b) permit you to post a completed resume directly on this Web Site. If you allow your resume to be searchable, then all those Employers who have access to our resume database product will have access to your resume. Subject to our use of this information in the assistance of law enforcement, correctional institutions and Homeland Security, we use our best efforts to grant access to this database only to Securus employees and representatives, Employers and their hiring managers, headhunters, and human resource professionals. However, we are not responsible if some other third party, such as someone posing as the aforementioned evades our security measures and gains access to the database, and, subsequently, your resume. If you post a resume on our Web Site, your resume and information on your resume will be searchable by all parties with access to our database. If you post a job on our Web Site, your company information and job description may be accessible to users of our database. You may remove your resume or other information from our Web Site, however, Employers and others may have retained a copy of your resume or information in their own databases. We are not responsible for the privacy or use of your information in such circumstances. We are not responsible for the use of your information in public areas of our Web Site. We may use your information to allow us to provide users with private and secure areas to post and modify their original content on our site (e.g., jobs and resumes). We may also collect demographic information such as gender, national original, race and veteran status. We also automatically track certain information based upon your behavior on the Web Site and use this information to do internal research on our users' demographics, interests, and behavior to better understand, protect and serve users in general. We will disclose your information if legally required to do so, or if requested by a governmental agency, national security agencies, participants in the law enforcement and corrections agencies, Homeland Security, Congress, Senate, or any representative of an incarcerating facility or criminal justice agency, both now and in the future, at the international, federal, state, county and local levels. How you can “Opt-Out”, Access, Update, or Delete Your information You can correct or update your resume at any time by logging into the Web Site using your username and password in order to implement such corrections or updates. Resumes remain active and online in our database for one year, however, you can delete your resume from our online database or close your account at any time, in which event we will remove all our copies of your resume and account profile information except for archival copies maintained by Securus. However, Employers and recruiters who have access to the database may have retained a copy of your resume in their own files or databases. We are not responsible for the retention, use, or privacy of resumes in these instances. We may need to retain your information in our archives and records in order to comply with law, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Website Terms and Conditions and other policies, and take other actions otherwise permitted by law. V. How we Protect your information We have reasonable procedures in place that limit access to your information to those employees and other individuals who need to know such information to provide services to you. We will maintain physical, electronic, and procedural safeguards to protect the confidentiality of your information as required by law. How we Protect the Privacy of Children The Children’s Online Privacy Protection Program took effect on April 21, 2000 and pertains to Websites directed towards children under 13 years of age. As a result, Securus has no control over the quality, safety, or legality of the jobs or profiles or resumes posted, the truth or accuracy of the listings, the ability of Employers to offer job opportunities to Job Seekers or the ability of Job Seekers to fill job openings, or any User Content, and Securus makes no representations about any jobs, profiles, resumes or User Content on the Web Site. Each Employer using the Web Site acknowledges and agrees that Job Seekers who post their employment profiles on the Web Site and /or apply for job openings through the Web Site are individuals who currently are incarcerated or have recently been released from incarceration, and possess a criminal record, which may or may not be disclosed on the resumes. Each Employer using the Web Site acknowledges and agrees that it is aware that the job candidates who may apply for job openings with said Employer through the Web Site or whose employment profile the Employer may review through the Web Site are individuals convicted of a crime. Selection, retention or hire of any individual is based solely on the Employer’s investigation, verification and determination that such hire is suitable. You assume full responsibility for implementing sufficient procedures and checks to satisfy your requirements for the accuracy and suitability of the Web Site, User Content and Information. YOU WILL RELEASE, AND INDEMNIFY, DEFEND AND HOLD HARMLESS SECURUS, ITS LICENSORS, ANY INCARCERATING OR CORRECTIONAL FACILITIES, ITS AND THEIR AFFILIATES, AND ITS AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES (THE "SECURUS PARTIES") FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, CLAIMS, DEMANDS, SUITS, LIABILITIES, FINES, PENALTIES AND EXPENSES (INCLUDING REASONABLE ATTORNEY'S FEES AND EXPENSES) (COLLECTIVELY, "CLAIMS") OF WHATEVER KIND, CHARACTER, OR NATURE, INCLUDING BUT NOT LIMITED TO CLAIMS ALLEGING PERSONAL INJURY, DEATH, ILLNESS, OR DAMAGE TO OR LOSS OF TANGIBLE PROPERTY, BROUGHT BY OR ON BEHALF OF ANY PERSON, THAT ARISE OUT OF, ARE RELATED TO OR ARE IN CONNECTION WITH THIS AGREEMENT OR YOUR ACCESS OR USE OF THE WEB SITE OR INFORMATION, INCLUDING BUT NOT LIMITED TO CLAIMS ARISING FROM THE EMPLOYMENT OF ANY INDIVIDUAL THROUGH THE USE OF THE WEB SITE, EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE JOINT, SOLE, OR CONCURRENT NEGLIGENCE, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, STRICT LIABILITY OR OTHER FAULT, WHETHER PASSIVE OR ACTIVE, OF ANY PERSON OR ENTITY, INCLUDING BUT NOT LIMITED TO THE SECURUS PARTIES. By using the Web Site, you agree to the terms of the Securus Online Privacy Policy. This Section shall survive termination of this Agreement. No Conflicting Terms. If there is any conflict between this Agreement and any help text, manuals, or other documents, this Agreement will govern, whether such other documents are prior to or subsequent to this Agreement, or are signed or acknowledged by any member of the Securus Parties. This Section shall survive termination of this Agreement. Attorney's Fees. If Securus takes action (by itself or through its representatives) to enforce any of the provisions of this Agreement, including collection of any amounts due hereunder, Securus is entitled to recover from you (and you agree to pay), in addition to all sums to which it is entitled or any other relief, at law or in equity, reasonable and necessary attorney's fees and any costs of any litigation. This Section shall survive termination of this Agreement. Governing Law; Limitations; Venue. This Agreement is governed by the laws of the State of Texas, excluding any rule or principle that would refer to and apply the substantive law of another state or jurisdiction. To the extent allowed by applicable law, any claims or causes of action arising from or relating to your access and use of the Web Site or Information contemplated by this Agreement must be instituted within two (2) years from the date upon which such claim or cause arose or was accrued. Further, any such claim or cause of action may only be brought in the state or federal courts located in [Dallas County, Texas,] and you agree to submit to the exclusive personal jurisdiction of such courts and hereby appoint the Secretary of State of Texas as your agent for service of process. Any unenforceable provision will be replaced by a mutually acceptable provision which comes closest to the intention of the parties at the time the original provision was agreed upon. Use, duplication or disclosure by the Government is subject to restrictions as set forth in applicable laws and regulations. Except as permitted in this Agreement, you may not copy, adapt, distribute, commercially exploit, or publicly display the Information or any portion thereof in any manner whatsoever without Securus' prior written consent. This includes, without limitation the terms “Job Assist” and “SECURUS” as well as the SECURUS design logo and certain other names and logos which are servicemarks and trademarks of SECURUS. Conduct: (a) You may not respond to postings by other Users in any manner or for any purpose other than that which is expected (i.e., to apply for the job).
